Plaintiff Drop, Inc. brings this action against Danial Danish, Danial Danish Consultancy, Inc., Erik Sundberg, and Azmi Consulting, Inc.
CHICAGO, IL, April 19, 2021: Plaintiff Drop sued Defendants Danial Danish, Danial Danish Consultancy, Inc., Erik Sundberg, and Azmi Consulting, Inc. Drop is an Illinois corporation headquartered in Hinsdale, Illinois. Danish Consultancy is headquartered in Las Vegas, Nevada. Defendant Danish, a U.S. Citizen, owns and is the Chief Operating Officer of Danish Consultancy. Defendant Azmi Consulting, Inc. is a Canadian corporation with its headquarters in Ontario, Canada, and is affiliated with Danish.
Drop is a technology company that developed a proprietary platform for sending ringless voice mails or RVMs, which are voicemail messages deposited without ringing the phone. In 2019, Danish agreed to acquire, manage, and maintain Drop’s RVM Phone Lines, and sell Drop’s RVM services to end customers, among other tasks. All in all, Danish and Drop signed four separate contracts; each time, Danish agreed to keep Drop’s information confidential and not use it for his own ends.
Danish hired Sundberg to provide technology assistance because Sundberg is an experienced network engineer familiar with telephony-based applications. Drop asserts that Danish needed this because Danish himself did not have the requisite programming ability.
Instead of abiding by their agreements, Drop alleges that Danish stole Drop’s code to compete with it. Danish then used Azmi Consulting to buy the telecom minutes he needed to run his competing business.
Drop seeks relief under the Defend Trade Secrets Act of 2016, the Computer Fraud and Abuse Act, the Illinois Trade Secrets Act, and common law.
