All kinds of injuries occur every day in the United States, but when the party responsible can be identified, they will likely end up in court to answer for their actions and pay the victim.
A child was injured during a hit and run accident in Nashville, Tennessee.
Law enforcement searches for driver who fled the scene
Metro police responded to the area of the 3000 block of Richmond Hills Drive in Madison. They found a 12 year old boy who was hit by a car while on his bike in the area. The car left the accident scene immediately, but based on debris and evidence at the scene police were able to determine that the car responsible was a silver sedan that would have front end damage.
Just hours after the incident, a 24 year old male dropped off a vehicle at a repair shop on Straightway Ave in East Nashville. The car was a silver Chevy Impala with damage to the windshield and the front end on the passenger side. The man who left the car has been identified and police have issued wanted notices around the area with his photo. They need to bring him in for questioning, and they are also asking anyone in the area who knows him or anything about the incident to call crime stoppers. Anonymous tips that lead to an arrest would be compensated with a cash reward.
Civil personal injury lawsuits
While this driver may be charged criminally for leaving the scene of an accident, any person or business that is found to be responsible for injuring another person can be sued in the civil court system. This can be done even if the charges are dropped or the person is never convicted. However, evidence of violation of a criminal law can be introduced in civil court, which is beneficial to the plaintiff’s case.
Civil personal injury attorneys assist their clients by filing a case in the local courts that asks for a certain monetary amount to compensate the victim for their losses. The lawyer will summarize the costs of things like medical treatment, hospitalization, missed time from work, and continued care in the pleadings and determine a total damage award based on these amounts.
Settlements when fault is obvious
If the defendant and their attorney feel that they may not be able to defend against the charges, they may decide to draft a settlement agreement that gives the plaintiff a fair amount of compensation. This can save time in court and money spent on legal fees for both sides.
